Arbitration Administrator & Rules

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as in effect at the time the arbitration is initiated.

  • Arbitration shall take place in Washington State, unless the parties agree otherwise.

  • Arbitration may be conducted in person, by telephone, or via video conference, at the arbitrator’s discretion.

Individual Basis Only

Arbitration shall be conducted on an individual basis only.
You and Safer H2O Corp. agree that:

  • No class actions

  • No class arbitrations

  • No private attorney general actions

The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions

Either party may bring a claim in small claims court in Washington State, provided the claim qualifies and remains in small claims court.

Claims involving intellectual property rights, trademarks, or misuse of proprietary materials may be brought in a court of competent jurisdiction.

Fees & Costs

Each party will bear its own attorneys’ fees unless otherwise required by law. Arbitration filing and administrative fees will be allocated in accordance with AAA Consumer Arbitration Rules.

Time Limitation

Any claim must be brought within one (1) year of the date the claim arose, unless a longer period is required by applicable law.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to:
